I want a divorce; where do I begin?

You are considering a divorce but have no idea where to begin.

The decision to get a divorce is one of the toughest decisions you’ll have to make in life. And it’s probably not one that happens overnight. Perhaps you’re still not entirely sure. You often don’t know what to expect. So, what is your first step?

Uiteen offers a non-committal introductory meeting of 30 minutes in which we hope to be able to answer all of your questions. This could include questions such as:

  1. Can I continue living in our house?
  2. How do I tell my partner and our children?
  3. How much does it cost to get divorced?
  4. How long does the process take?
  5. How much of a budget will I be left with?

Moreover, you will have to decide the way in which you would like to get a divorce. Could this be done in consultation with the help of an independent mediator? Or would you prefer your own lawyer? If you have your own lawyer, you can also still choose to arrange your divorce in consultation with your ex-partner. This is called a consultation divorce or a collaborative divorce. Your lawyer will need a lot of information to properly guide you through a divorce. You will need to provide personal details of you, your partner and the children, and an overview of your possessions, debts, income and retirement. On the basis of this information, a division of the assets will be arrived at in consultation and, where applicable, agreements regarding spousal and child maintenance will be made.
If you have children, you and your partner will need to draw up a parenting plan. Without a parenting plan it is (near) impossible to arrange a divorce. The consequences of your divorce for the children are laid out in a parenting plan, including matters such as the division of care, financial agreements concerning the children. Your mediator and/or lawyer will help you and your partner to draw up such a plan.
